Que es la discreción fiscal y cómo trabaja?


Discreción fiscal (casualmente denominado "PD") se produce cuando el Departamento de Seguridad Nacional ejerce sus facultades discrecionales en la concesión de algún tipo de beneficio para un extranjero. En tales casos, el extranjero típicamente no tiene derecho a un beneficio como una cuestión de derecho, pero el Departamento se compromete a utilizar su discreción en favor del solicitante de todos modos.

PD puede venir de muchas maneras y puede ser el resultado de diferentes hechos específicos para el caso de un solicitante. Por ejemplo, si usted está en un proceso de deportación (es decir, usted está asistiendo actualmente audiencias frente a un juez de inmigración), el Departamento puede estar de acuerdo para cerrar administrativamente su caso, reabrir su caso (si has tenido previamente una orden de expulsión), o terminar sus procesos en total. Si usted no está en un proceso de deportación, luego PD puede venir en la forma de una subvención de DACA (Acción Diferida para la Infancia llegadas), Acción Diferida (para las personas que no caen bajo las regulaciones DACA de Obama), o una concesión de la suspensión de la eliminación (esto se produce después de una orden de expulsión y le permite tener un permiso de trabajo).

 
Ventajas y Desventajas de la discreción fiscal

Los beneficios de la PD son evidentes: que ya no está en proceso de expulsión es, usted ya no tendrá que presentarse a las audiencias judiciales, o que ya no tienen una orden de expulsión. La obtención de la PD en estos casos le permite continuar una vida relativamente normal sin la preocupación de la deportación inminente.

La desventaja es principalmente que cierre o terminación de un proceso de deportación, mientras que le permite permanecer indefinidamente en los EE.UU. (con o sin permiso de trabajo en algunos casos), no obtendrá una tarjeta verde, ya que no va a tener una audiencia final; que sería en lugar de elegir para detener todas las audiencias de manera indefinida.

 
¿Quién puede y no puede obtener la PD?

Esto no es una respuesta absoluta, porque, después de todo, la obtención de la PD está dentro de la discreción del Departamento. En general, los encuestados que obtengan PD son capaces de hacerlo debido a circunstancias simpáticas (parientes enfermos, larga residencia en los EE.UU., la falta de antecedentes penales, etc.), mientras que los encuestados que no obtengan PD tienen factores agravantes como antecedentes penales graves, la eliminación órdenes, recientes y / o varias-entradas a los EE.UU., etc.

Un encuestado maximiza sus posibilidades de obtener PD por tener un abogado ya que el abogado es el único que puede negociar con los abogados del gobierno y el juez de inmigración. Los encuestados con ningún abogado están tomando un gran riesgo, ya que generalmente no tienen el mismo acceso a un abogado tendría que los jueces o los abogados del gobierno.
